These Terms and Conditions govern the use of the ArtJel website and purchases made from ArtJel.
ArtJel is operated by Aria Aviation Ltd, a company registered in England and Wales under company number 12129597, with its registered office at 136 St. Albans Road, Watford, England, WD24 4FT.
References to “ArtJel”, “we”, “us” or “our” mean Aria Aviation Ltd trading as ArtJel. References to “you” or “customer” mean the person purchasing or seeking to purchase goods from us.
These Terms apply together with any applicable quotation, order confirmation or separate Sales Agreement. Nothing in these Terms excludes or limits any consumer rights that cannot lawfully be excluded or limited.
1. About ArtJel
ArtJel specialises in fine art, sculpture, heritage crafts, decorative objects, artisan works and other art and craft items.
Products may be sourced from artists, artisans, workshops, manufacturers and specialist suppliers in the United Kingdom and internationally.
Certain items may be specially sourced, commissioned, customised, finished, prepared or made to order following confirmation of a customer’s purchase.
2. Product Information
We take reasonable care to ensure that product descriptions, photographs, measurements, materials and other information displayed on our website are accurate.
The appearance of colours, textures and finishes may vary because of photography, lighting, screen settings and the individual characteristics of the artwork.
Customers should rely on the dimensions, materials and specifications stated in the product description, quotation, order confirmation or applicable Sales Agreement.
If a particular measurement, material, finish, colour or other characteristic is important to you, please contact ArtJel before placing or confirming your order.
3. Handcrafted Variations
Handcrafted artworks are inherently individual. No two handmade pieces should be expected to be completely identical.
Reasonable variations may occur in colour, tone, patina, grain, texture, surface finish, markings, detailing, dimensions, weight and other characteristics arising from the materials and handmade production process.
Natural materials, including metals, wood, stone, pigments and other artisan materials, may also exhibit natural variations and may develop or change in appearance over time.
Reasonable variations of this nature form part of the character and authenticity of handcrafted work and do not, by themselves, constitute a fault. This does not affect your statutory rights if an item is faulty, damaged, not as described or otherwise fails to conform to the contract.
4. Photographs, Videos and 3D or AR Visualisations
Product photographs, videos, three-dimensional models and augmented-reality visualisations are provided for illustrative and visualisation purposes.
A representative three-dimensional model may not be a precise digital reproduction of the individual handcrafted piece ultimately supplied.
Augmented-reality features are intended primarily to help customers visualise the approximate scale, proportions and appearance of an artwork in their surroundings. Screen settings, lighting, camera technology and the augmented-reality system itself may affect how an artwork appears.
Customers should rely on the stated dimensions and specifications when determining whether an item is suitable for a particular space.
5. Prices and Quotations
Prices displayed on the ArtJel website will be shown in the currency applicable to the selected market where available.
The price payable will be the price confirmed at checkout or stated in the applicable quotation, order confirmation or Sales Agreement.
Before you become bound by an order, we will provide the total price, including applicable taxes and any delivery charges that can reasonably be calculated in advance.
For made-to-order, bespoke, specially sourced, unusually large or internationally delivered pieces, ArtJel may provide a formal quotation confirming the product price, specifications, shipping costs and other applicable charges.
Submitting a quotation request does not oblige you to purchase an item.
A quotation may have a stated period of validity and may be withdrawn or revised before an order is accepted.
6. Orders and Acceptance
An order submitted through the website constitutes an offer to purchase. An enquiry, quotation request or other preliminary communication does not create a binding order.
We may decline an order before acceptance if an item is unavailable, there is an obvious error in its price or description, we cannot arrange delivery to the stated destination, required payment has not been received or we reasonably believe that we cannot fulfil the order.
A contract for sale will arise when ArtJel accepts the order in accordance with the applicable ordering process, written order confirmation or Sales Agreement.
For high-value, commissioned, customised, specially sourced or made-to-order items, we may require a separate Sales Agreement before the order is finally accepted or production or procurement begins.
7. Payment
Payment must be made using a payment method accepted by ArtJel.
Payment requirements will be shown at checkout or stated in the applicable quotation, invoice, order confirmation or Sales Agreement.
For commissioned, bespoke or made-to-order work, ArtJel may require full payment, a deposit or staged payments before production or procurement begins.
Production, commissioning, customisation or procurement will not normally begin until the payment required at that stage has been received and cleared.
Any deposit, advance payment or cancellation charge will be handled in accordance with the applicable Sales Agreement and consumer law. Nothing in these Terms permits ArtJel to retain an amount that it would be unlawful or unfair to retain.
8. Sourcing, Production and Commissioned Items
Certain products displayed by ArtJel may not be held in stock by us.
Following confirmation of an order, ArtJel may procure an item from an artist, artisan, workshop, manufacturer, specialist supplier or another source.
Some products may be commissioned, manufactured, customised, finished or otherwise prepared specifically following the customer’s order.
Where applicable, estimated production, procurement or preparation times will be communicated before the order is confirmed.
Production and procurement times are estimates unless a particular deadline has expressly been agreed as binding.
Traditional craftsmanship can involve processes that cannot always be completed to an exact timetable. We will take reasonable steps to inform customers of material delays and comply with any applicable rights relating to delayed performance or delivery.
9. Bespoke, Personalised and Made-to-Specification Goods
Some ArtJel products may be made to the customer’s specifications, clearly personalised, specially commissioned or created according to requirements agreed specifically with that customer.
Where an item falls within the applicable legal exception for goods made to a consumer’s specifications or clearly personalised, the statutory right to cancel a distance contract simply because the customer has changed their mind will not normally apply.
Where applicable, we will identify an item as bespoke, personalised or made to specification before the customer becomes bound by the purchase.
The fact that an item is sourced or ordered from a supplier after a customer places an order does not, by itself, necessarily make that item bespoke or personalised.
Nothing in this section affects statutory rights where goods are faulty, damaged, not as described, not of satisfactory quality or otherwise fail to conform to the contract.
10. Cancellations and Changes
UK consumers purchasing standard, non-personalised items online will normally have the right to cancel without giving a reason by notifying ArtJel within 14 days beginning on the day after receiving the item.
After notifying us, the customer must return the item within a further 14 days. Further information is provided in our Returns, Cancellations & Refunds policy.
Where an applicable exception for genuinely bespoke or personalised goods applies, cancellation because of a change of mind will only be permitted if provided for in the applicable Sales Agreement or expressly agreed by ArtJel in writing.
Requests to alter an order after it has been accepted will be considered where reasonably possible. Changes may result in additional costs or changes to the estimated completion or delivery date. Any additional cost will be explained before the requested change is approved.
11. Shipping and Delivery
Shipping arrangements depend on the size, weight, value, fragility and destination of the artwork.
Large, fragile or valuable works may require specialist packing, crating, insurance, handling or freight services.
Delivery arrangements, estimated timescales and applicable charges will be displayed, quoted or otherwise communicated before the customer becomes bound by the order where required.
Unless a different delivery period has been agreed, goods will normally be delivered within 30 days of the contract being formed. Bespoke and made-to-order goods may have a longer agreed production and delivery period.
Delivery dates and times are estimates unless a particular date has expressly been agreed as binding.

12. Delivery Access and Installation
Customers are responsible for providing complete and accurate delivery information and ensuring that the delivery location is reasonably accessible for the relevant item.
Before purchasing a large, heavy or specialist item, customers should consider doors, corridors, access routes, stairs, lifts, loading restrictions, parking restrictions, floor loading, structural suitability, mounting requirements, installation requirements and any other conditions affecting safe delivery.
Unless installation, lifting, mounting or positioning is expressly included in the quotation or Sales Agreement, the customer is responsible for arranging these services.
Additional reasonable costs arising from incorrect delivery information, failed delivery or inaccessible premises may be charged where lawful and appropriate.
13. International Orders, Customs, Duties and Taxes
ArtJel may supply artworks internationally.
International deliveries may be subject to customs procedures, import duties, import taxes, local taxes, brokerage charges, customs-clearance charges and other fees imposed by governmental authorities, carriers or third parties.
Unless expressly stated otherwise in writing, these charges are not included in the product price or delivery charge and are the customer’s responsibility.
Customers are responsible for checking whether an artwork may lawfully be imported into the destination country and for providing any information or documentation reasonably required for customs clearance.
ArtJel is not responsible for customs or import delays outside our reasonable control. Nothing in this section makes the customer responsible for a charge that applicable law requires ArtJel to bear or that should legally have been disclosed before the order.
14. Inspection and Damage During Delivery
Customers should inspect an item as soon as reasonably practicable following delivery.
If an item appears to have been damaged during delivery, please photograph the external packaging before opening it where reasonably possible. You should also photograph the item, internal packaging and visible damage, retain the item and all packaging, and contact ArtJel promptly with your order details and supporting photographs or video.
Prompt notification helps us investigate the matter with the carrier, insurer or supplier. A delay in reporting damage does not remove any statutory consumer rights that cannot lawfully be excluded.
Depending on the circumstances and applicable law, the appropriate remedy may include repair, replacement, a price reduction or refund.
15. Returns and Refunds
Returns, cancellations and refunds are governed by our Returns, Cancellations & Refunds policy, these Terms, any applicable Sales Agreement and applicable law.
Where a customer has a statutory right to cancel or return goods, ArtJel will honour that right.
Where an applicable legal exception means that a statutory change-of-mind cancellation right does not apply, ArtJel is not required to accept a cancellation or return merely because the customer has changed their mind.
Nothing in these Terms excludes or restricts statutory rights relating to goods that are faulty, damaged, not as described, not of satisfactory quality, unfit for their intended purpose or otherwise fail to conform to the contract.
16. Ownership and Risk
Ownership of goods will pass in accordance with the applicable Sales Agreement or, where there is no separate provision, after ArtJel has received full cleared payment for the goods.
For consumer purchases, risk in the goods will pass when the goods come into the physical possession of the customer or a person identified by the customer to receive them, except where applicable law provides otherwise.
Nothing in these Terms transfers risk to a consumer earlier than permitted by law.
17. Authenticity, Provenance and Artistic Attribution
Information concerning an artwork’s origin, artist, artisan, maker, materials, manufacturing method, provenance, age or other characteristics will be based on information reasonably available to ArtJel, including information provided by the artist, artisan, workshop, manufacturer or supplier.
Where a certificate of authenticity, provenance document or other supporting documentation is included, this will be stated in the product description, quotation, order confirmation or Sales Agreement.
Customers should not assume that a certificate or provenance documentation is included unless this is expressly stated.
18. Intellectual Property
Unless otherwise stated, the ArtJel name, logo, website design, text, graphics and other ArtJel-created materials are protected by applicable intellectual-property laws.
Product photographs, images and information may also belong to ArtJel, the relevant artist, artisan, manufacturer, supplier or another rights holder.
Website content may not be copied, reproduced, distributed or commercially exploited without appropriate permission, except where permitted by law.
Purchase of an artwork does not transfer copyright, reproduction rights or any other intellectual-property rights in the artwork unless expressly agreed in writing.
19. Website Availability and Information
We take reasonable care to keep the ArtJel website accurate and available but do not guarantee uninterrupted or error-free access.
Artworks may become unavailable, specifications may be updated and obvious errors in pricing or other information may occasionally occur.
Where an obvious error is identified before an order is accepted, ArtJel may correct the information and allow the customer to proceed on the corrected basis.
Changes to website information will not retrospectively alter an existing contract unless agreed with the customer or permitted by law.
20. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or statutory consumer rights that cannot legally be excluded or restricted.
Where you purchase as a consumer, ArtJel is responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer.
If goods are purchased wholly or mainly for business purposes, additional reasonable limitations may be included in the applicable Sales Agreement.
21. Events Outside Our Reasonable Control
Subject to applicable consumer rights, ArtJel will not be responsible for delay or failure to perform caused by circumstances outside our reasonable control.
Such circumstances may include severe weather, natural disasters, transport disruption, carrier or customs delays, industrial action, governmental restrictions, war, civil disturbance, supply-chain disruption, export or import restrictions or disruption affecting artists, artisans, workshops, manufacturers or suppliers.
Where such circumstances materially affect an order, we will take reasonable steps to inform the customer and determine an appropriate course of action.
22. Privacy
Personal information is processed in accordance with our Privacy Policy and applicable data-protection law.

23. Changes to These Terms
ArtJel may update these Terms from time to time.
The Terms applicable to an order will normally be those in effect when the relevant contract is formed, together with any quotation, order confirmation or Sales Agreement applicable to that purchase.
24. Governing Law and Jurisdiction
These Terms and contracts between ArtJel and its customers are governed by the laws of England and Wales.
If you are a consumer resident outside England and Wales, you may also benefit from mandatory protections under the laws of your country or place of residence. Nothing in these Terms removes those protections.
The courts of England and Wales will have jurisdiction, subject to any right a consumer may have to bring proceedings in another competent jurisdiction under applicable law.

ArtJel will provide the appropriate return address and return instructions after a return request has been reviewed.

26. Model Cancellation Form
Complete and email this form only if you wish to cancel a contract for which a statutory cancellation right applies. You may instead send an email containing a clear statement that you wish to cancel.
